Following the recent decriminalization of the marijuana via the amendments to the Misuse of Drugs (Amendment) Act, 2017, the regulations, “Gazetted” on March 16th, 2019, implement a $100 fine on any person who is found in violation of the Act.
The Social Security (Registration of Employers and Employed Persons) (Amendment) Regulations, 2019 amends several sections of the principal regulation. These include changes to sections 2, 4 and 5 of the regulations. Principal among these changes is the change to Regulation 4, which has to do with the Registration of Employed persons. Regulations made by the Comptroller of Customs on section 134(2) of the Customs Regulation Act. The amendment of regulation 2 renumbers the regulation as sub-regulation (1) and inserts new sub-regulations (2) and (3). Sub-regulation (2) states that the Customs Form C 200 or any other replacement form may be attached to the disembarkation card. Moreover, sub-regulation (3) declares that the Customs Form C 200 can be set out in English, Spanish or any other language the Comptroller may determine. Consequently, the documents available in other languages help to ensure effective communication. Lastly, Schedule I for regulation 2 is repealed and replaced with a revised customs declaration form.
This regulation specifies that every person arriving into Belize shall fill out and sign a disembarkation card in the form set out in the Schedule. Corresponding the Customs (Declaration form and Green Line Notice) (Amendment) Regulations 2019, the Immigration (Disembarkation Card) Regulations 2019 states that the Disembarkation Card may be attached to the “Customs Forms C 200”. In similar fashion to the aforementioned Customs amendment, the Disembarkation Card shall be set out in English, Spanish or any other language the Director of Border Management and Immigration Services may determine.
In conjunction with the Disembarkation Card, this regulation addresses the Embarkation Card, which requires every person departing from Belize to fill out and sign the form set out in the Schedule.
